What If a Buyer Misuses Our Licensed Data? How Owners Stay Protected
By Andrew Smart, founder of MON$TER · About
It's one of the first questions owners ask: "If we license our data, what stops a buyer from misusing it?" It's a fair worry. The good news is that a well-built licensing deal protects you in several layers.
Layer 1: send less, and make it anonymous
The best protection is what never leaves your building. Licensed data should have personal information removed and be anonymized so no one can reasonably identify people or customers. See what counts as PII and anonymized data monetization. Buyers see a description first, never your raw data.
Layer 2: the license spells out what's allowed
- Permitted uses: exactly what the buyer may do with the data, and nothing more
- No re-identification: a ban on trying to figure out who is behind the records
- No resale: limits on passing the data to anyone else
- Term and deletion: how long the license lasts and what happens to the data when it ends
More on these in key data licensing agreement terms and what a data processing agreement is.
Layer 3: remedies if something goes wrong
Agreements commonly include audit or certification rights, a right to end the license after a breach, and indemnity terms. Which of these you get depends on the deal, which is why you should have your own attorney review it. See do I need a lawyer to license data?
